IMPERIAL COUNTY, CA- The wife of a California Highway Patrol officer convicted of murdering him has been denied an appeal to overturn her conviction.
Kym Cano was convicted of second degree murder in June 2010.
She was sentenced to 40 years to life for murdering her husband Francisco in December 2006.
During the trial the defense argued Cano suffered from battered women's syndrome and that she lived in constant fear of Francisco.
Cano's appeal contends the court committed reversible error by failing to instruct the jury that an unintentional killing committed without malice constitutes voluntary manslaughter.
Both the Appeals Court and Supreme Court denied her appeal.
