Attorney for convicted sex offender Johnnie Swaim files motion to appeal sentencing

IMPERIAL VALLEY, Calif. (13 On Your Side) – Less than 24 hours after a judge sentenced convicted child molester Johnnie Swaim to ten years in prison, his defense attorney has filed a motion to appeal the sentencing.

In February, a jury found the former California Highway Patrol Lieutenant guilty of molesting his two daughters more than a decade ago.

His attorney, Robert Espinoza, tells 13 On Your Side he filed the appeal because he believes the judge should not have allowed the jury to hear evidence from a previous molestation case filed against Swaim in 1995.

In that case, a jury acquitted Swaim of molesting his step-daughter.
